RESUMEN: El presente artículo tiene por objetivo analizar la jurisprudencia de la Corte Interamericana de Derechos Humanos en materia de movilidad humana bajo la óptica de la doctrina filosófica del cosmopolitismo. A partir del desarrollo de las principales características de esta doctrina en relación a la migración (tensión entre nacionalidad, ciudadanía y derechos, así como las perspectivas actuales de solidaridad global), se sostendrá que la jurisprudencia interamericana tiende hacia al cosmopolitismo.ABSTRACT: The purpose of this article is to analyze the jurisprudence (...) of the Inter - American Court of Human Rights in the field of human mobility from the perspective of the philosophical doctrine of cosmopolitanism. In the Treatise of Human Nature , Hume argues that, because we have adequate ideas of the smallest parts of space, we can infer that space itself must conform to our representations of it. The paper examines two challenges to this argument based on Descartes's and Locke's treatments of adequate ideas, ideas that fully capture the objects they represent. The first challenge, posed by Arnauld in his Objections to the Meditations , asks how we can know that an idea is (...) adequate. The second challenge, implicit in Locke's Essay , asks how an empiricist can characterize an idea as inadequate, as both picking out an object and yet failing to capture it fully. In showing how Hume responds to these challenges, his theory of perceptual representation is explained and his treatment of space is related to his scepticism. His conclusion is shown not to be a characterization of space as it exists wholly apart from our powers of conception. Instead, in an adumbration of Kant, his claim is restricted to space as it appears to us. (shrink)

The current interest in bioregionalism, stimulated in part by Kirkpatrick Sale’s Dwellers in the Land, shows that people are looking for a form of political praxis which addresses the importance of region. In this paper, I argue that much of the bioregional literature written to date mystifies the concept of region, discounting the role of subjectivity and culture in shaping regional boundaries and veers toward asimplistic view of “nature knows best.” Bioregionalism can be rehabilitated, provided we treat it not as (...) a “revealed wisdom” for the reconstruction of human society, but as a sensibility and environmental ethic that can infuse our work even as we make use of the functional regionalisms that increasingly shape people’s consciousness. I conclude by citing Lewis Mumford’s concept of a region as capturing the dialectical interplay of natural and cultural elements. (shrink)

ABSTRACT According to David Lewis, alteration is "qualitative difference between temporal parts of something." It follows that moments, since they are simple and lack temporal parts, cannot alter from future to present to past. Here then is another way to put McTaggart's paradox about change in tense. I will appeal to my theory of Aspects to rebut the thought behind this rendition of McTaggart. On my theory, it is possible that qualitatively differing things be numerically identical. I call these differing, (...) numerically identical things "aspects." I will argue that alteration can be a qualitative difference between temporal aspects of something that lacks temporal parts. So a moment can alter in tense. By rejecting Lewis's assumption my theory can solve this version of McTaggart's paradox. (shrink)

This paper introduces the important concept of a biophysical perspective on economics into the business ethics literature. The biophysical perspective recognizes that ecological processes determine what can be done in an economy and how best to do it. A biophysical perspective places the economic system into a larger context of the ecologic system. This changes the perception of ethical issues by identifying a larger scope of management decisions. The paper examines the changing ethical landscape in such issues as biotechnology, planned (...) obsolescence, productivity, and international trade. The paper also examines the shift in mindset associated with the shift in economic framework. It draws on the literature on cognitive structures and moral imagination to show this new perspective can actually raise the bar for ethical decision-making and behavior. The pattern is that the ethical behavior associated with a biophysical economic framework has a greater scope of responsibility with the benefit that the required ethical behavior leads to better long-term decision making. In Hume's True Scepticism, I offer a new interpretation of David Hume's epistemology and philosophy of mind as presented in A Treatise of Human Nature.1 I approach this task by developing what I take to be the first comprehensive2 investigation of Part 4 of Book 1. The arguments Hume offers there have frequently been addressed by the secondary literature in a piecemeal fashion, especially his account of personal identity and of our belief in the external world. The idea that the self is in need of rethinking, as the title to this collection of essays suggests, presupposes that the self has already been “thought.” And indeed it has—both explicitly, by philosophers, and implicitly, in the practices of everyday life. For philosophers, this thinking about the self has taken place largely in abstract terms; persons have been treated as metaphysical-cum-moral subjects, disembodied minds that could plausibly be split from or melded with other such minds, or as rational agents, (...) capable of choosing a plan in terms of which to live their lives. In everyday life, in contrast, we “think” one another as selves by making assumptions about how the people we encounter fit into the social landscape and about how we ourselves have a place in the world. Over four decades, research and policy have created layers of understandings in the quest for "good" corporate governance. The corporate excesses of the 1970s sparked a search for market mechanisms and disclosure to empower shareholders. The UK-focused problems of the 1990s prompted board-centric, structural approaches, while the fall of Enron and many other companies in the early 2000s heightened emphasis on director independence and professionalism. With the financial crisis of 2007–09, however, came a turn in some policy approaches and in (...) academic literature seeking a different way forward. This paper explores those four phases and the discourse each develops and then links each to assumptions about accountability and cognition. After the financial crisis came pointers in policy and practice away from narrow, rationalist prescriptions and toward what the philosopher Stephen Toulmin calls "reasonableness". Acknowledging that heightens awareness of complexity and interdependence in corporate governance practice. The paper then articulates a research agenda concerning what "reasonably" good corporate governance might entail. (shrink)

The Forest Stewardship Council (FSC) is a global private governance system overseeing the sustainability and biodiversity of the world forestry system through certification of forests and forestry processes and products, and is perceived as the strongest of the various certification schemes available (Domask, Globalization and NGOs: Transforming Business, Government, and Society , 2003 ; Gulbrandsen, Global Environmental Politics , 2004 ). It has seen more success in developed than developing countries in terms of amount of forest certified and number of (...) chain-of-custody certificates issued, raising questions as to its ability to promote biodiversity Gulbrandsen, Global Environmental Politics , 2004 ). A number of challenges have risen to the pragmatic and moral legitimacy of the FSC as a global governance system: alternative certification schemes, output and market access, cost of certification, plantations, and illegal logging. I examine each of these challenges as they pertain to the dimensions of pragmatic and moral legitimacy of the FSC. I conclude with a discussion of theoretical implications for global governance systems using ecolabel schemes, as well as a discussion of practical implications for the FSC in particular. (shrink)

This article explains Aquinas's attempt to show, within an Aristotelian framework, how the soul can be both a substance in its own right and the form of the body. I argue that although Aquinas' theory is logically consistent, its plausibility is weakened by the fact that it requires a significant modification of the Aristotelian conceptions of both substance and form.

Cognitive neuroscientists have anticipated the union of neural and behavioral science with ethics (Gazzaniga 2005). The identification of an ethical rule—the dictum that we should treat others in the manner in which we would like to be treated—apparently widespread among human societies suggests a dependence on fundamental human brain mechanisms. Now, studies of neural and molecular mechanisms that underlie the feeling of fear suggest how this form of ethical behavior is produced. Counterintuitively, a new theory presented here states that it (...) is actually a loss of social information that leads to sharing others' fears with our own, thus allowing us to treat others as we would like to be treated. Adding to that hypothetical mechanism is the well-studied predilection toward affiliative behaviors. Thus, even as Chomsky hypothesizes that humans are predisposed to utter grammatical sentences, we propose that humans are 'wired for reciprocity'. However, these two neural forces supporting ethical behavior do not explain individual or collective violence. At any given moment, the ability to produce behavior that obeys this ethical rule is proposed to depend on a balance between mechanisms for prosocial and antisocial behaviors. That balance results not only from genetic influences on temperament but also from environmental effects particularly during critical neonatal and pubertal periods. (shrink)

While its mechanism and biological significance are unknown, the utility of a short mitochondrial DNA sequence as a “barcode” providing accurate species identification has revolutionized the classification of organisms. Since highest accuracy was achieved with recently diverged species, hopes were raised that barcodes would throw light on the speciation process. Indeed, a failure of a maternally donated, rapidly mutating, mitochondrial genome to coadapt its gene products with those of a paternally donated nuclear genome could result in developmental failure, thus creating (...) a post-zygotic barrier leading to reproductive isolation and sympatric branching into independent species. However, the barcode itself encodes a highly conserved, species-invariant, protein, and the discriminatory power resides in the non-amino acid specific bases of synonymous codons. It is here shown how the latter could register changes in the oligonucleotide frequencies of nuclear DNA that, when they fail to match in pairing meiotic chromosomes, could reproductively isolate the parents so launching a primary divergence into two species. It is proposed that, while not itself contributing to speciation, the barcode sequence provides an index of the nuclear DNA oligonucleotide frequencies that drive speciation. (shrink)

In this paper, we reflect upon our experience in Mexico, as weIl as review the literature on reflection developed by adult educators in the United States in order to begin to develop a theory of “relevant retlection” useful for family literacy practitioners. We feel that engaging in relevant reflection can help to empower family literacy practitioners in the United States to work more effectively with participants and help participants think more critically about the meaning of literacy in their lives. It (...) is the participant’s perception of their life-world that we hold to be valid. In the context of family literacy, our initial interest is in promoting the exploration of the educational validity of a certain form of reflection as it relates to learning process and outcomes. Our theory derived from reviewing the literature on reflection and critical reflection is thus stated: When family literacy paticipants are encouraged to reflect upon the relevance of literacy as it relates to their life-world, learning is significantly enhanced. Relevant reflection can be facilitated through engaging participants in reflecting upon the relevance of literacy to their lives, their families, their communities and their livelihoods. Indeed, this can be done individuaIly, in dialogue with another and/or as a group. Family literacy practitioners are provided a framework for facilitating relevant reflection for participants. Frank Tipler's The Physics of Immortality provides abundant cause for intellectual offense—including challenges to physics, to theology, and, seemingly, to common sense. Few philosophical conundrums remain unaddressed. Still, the book is stimulating and well presented.

Auf der einen Seite gibt es Gesichtspunkte, die ihn mit einer Phänomenalismuslehre verbinden, nach welcher die Körper nichts anderes als koordinierte Perzeptionen unausgedehnter Monaden sind. Auf der anderen Seite gibt es Griinde, die dafur sprechen, daß Leibniz die Auffassung vertreten muß, daß Körper Aggregate von Monaden sind. In diesem Aufsatz suche ich zu zeigen, daß die phanomenalistische Interpretation aufgrund der starken Textzeugnisse, (...) die Leibniz beständig zur Aggregatthese hindrängen, zuriickzuweisen ist. Daruber hinaus weise ich jedoch die verbreitete Auffassung eben der Aggregatthese zurück, d. h. die Meinung, gewisse Vielheiten von Monaden riefen bloß die Illusion, Körper zu sein, hervor, wenn sie durch andere Monaden M falsch perzipiert" werden. Gegen diese Auffassung des falschen Perzipierens ftihre ich ins Feld, daß die Aggregatthese als ein Deutungsversuch der Natur oder des Wesens des Körpers verstanden werden mufi. Wenn Leibniz sagt, Körper seien Aggregate von Monaden, so ist das nicht als blofie Behauptung, gewisse Monaden erschienen anderen Monaden als Körper, zu verstehen, sondern als die These, daß jeder Körper seinem Wesen nach eine Vielheit von Monadenist. A variation of Bell's theorem that deals with the indeterministic case is formulated and proved within the logical framework of Lewis's theory of counterfactuals. The no-faster-than-light-influence condition is expressed in terms of Lewis would counterfactual conditionals. Objections to this procedure raised by certain philosophers of science are examined and answered. The theorem shows that the incompatibility between the predictions of quantum theory and the idea of no faster-than-light influence cannot be ascribed to any auxiliary or tacit assumption of either determinism (...) or the related idea that outcomes of unperformed measurements are determinate within nature. In addition, the theorem provides an example of an application of Lewis's theory of counterfactuals in a rigorous scientific context. (shrink)
